According to the modifications, insolvency is presumed as existent when the debtor, after 90 days since the deadline, has not paid their debt towards the creditor, this presumption being relative. Previously, the insolvency status was presumed when debts were not paid within 30 days since the deadline.
Creditors including public employees will be able to request the opening of the insolvency procedure only in the case when, after the reciprocal debts of any type are compensated, the amount owed to them exceeds Lei 45,000 as opposed to Lei 30,000 which was until now, and the debt has exceeded 90 days since its due payment.
