OFFICIAL GAZETTE 854/21.12 - Law no. 246/2010 issued on 14/12/2010, regarding the approval of the Government Emergency Ordinance no. 77/2009 on organization and operation of gambling
This law includes provisions on the organization of online gambling:
- bingo games organized via Internet-type communication systems, via fixed or mobile telephone communication-systems;
- on-line betting representing betting on fixed rate activities, organized via Internet-type communication systems, via fixed or mobile telephone communication-systems;
- other types of on-line gambling that are carried out otherwise than in the physical presence of the players, organized and transmitted via Internet-type communication systems, via fixed or mobile telephone communication-systems and for which a gambling organizer has obtained a license and a permit.
In the case of the gambling involving slot type gambling machines, the permit can be obtained if the number of slot-machines for each location is:
- at least 15 machines – if the space in which, besides other activities that take place within the location, of other type than gambling operation and if only this particular category of game is being operated; previously, the minimum number was 20;
- at least two machines, but no more than 5, for the locations approved to operate activities of betting or lottery. Previously, there was not set a maximum limit.
There were also introduced two situations in which the committee may decide, depending on the consequences, license withdrawal. Thus, the license might be withdrawn in the following situations:
- there are irregularities in terms of the earnings awarded, the amounts are withheld or unpaid, there is a delay in payment of more than 30 days, and any failure of any breach of licensing conditions set by the rules and approval by this emergency ordinance or by any other regulations;
- non-compliance with the provisions of Law no. 656/2002 – amended and supplemented, on preventing and sanctioning money laundering, and instituting measures in order to prevent and combat terrorism financing.
