Tax authorities want information on the properties owned in Romania by the EU residents

Local administrations, through specialized departments will declare to ANAF a series of information about the properties owned by residents from other EU member states (natural or legal persons) in Romania (owner information, mode of acquisition value and property characteristics etc).

The obligation arises from art. 53 paragraph (5) of the Government Ordinance no. 92/2003 regarding the Fiscal Procedure Code which stipulates that local administrations must provide periodically to ANAF information about the immovable assets owned on their territory by the residents from an EU member state.

The purpose is the transmission of these information to the tax administrations of the EU member states, in accordance with the provisions of the Directive 2011/16 / EU transposed in the Fiscal Procedure Code at Title VII.

Thereby, the specialized departments of the local administrations have to collect information and to send these persons statements to ANAF.

The form and content of the statements were developed and published as order of the Ministry of Public Finance and Ministry of Regional Development and Public Administration on the MPF’s website. The project proposes the model of the “Informative statement regarding the real estate properties owned by residents of other EU member states”.

The statement is submitted annually until April 10th including the current year, for the previous year for information on real estate properties owned in Romania by residents of other EU member states.

Property owners could be non-resident natural persons (any natural person who is not resident natural person) and / or non-resident legal persons (any legal person who is not a Romanian legal person and any legal person created under the European legislation which does not have the head office in Romania).
